(A) The owner and/or operator of a large construction site, greater than five acres or part of a common plan of development greater than five acres, required to have an NPDES or TPDES permit to discharge stormwater associated with construction activity shall submit a copy of the notice of intent (NOI) to the city at least 48 hours prior to construction activity commencing. The owner and/or operator of a small construction site, greater than one acre but less than five acres and not part of a larger common plan of development greater than five acres, shall submit a copy of the construction site notice to the city a minimum of 48 hours before construction activities begin.

(C) A person commits an offense if the person owns or operates a construction site that is discharging stormwater associated with a regulated construction activity without having submitted a copy of the notice of intent to do so to the city.
