111.01 COUNCIL MAY SELL CITY OWNED REAL PROPERTY.
   (a)   Upon the effective date of this section, Council may sell any real estate owned by the City, valued at no more than fifteen thousand dollars ($15,000.00), without an auction or sealed bids by listing the property itself or by the use of a realtor and, in either case, by listing the real estate for sale on a national or statewide listing such as MLS or Zillow, for a minimum of thirty (30) days.
   (b)   Council may restrict the use of the property being sold and require specific development of the property to facilitate economic development projects and/or to provide necessary and convenient resources for the benefit of the residents of the City. In doing so, Council may require the prospective purchaser to submit a plan with an overview of the proposed project, documents exhibiting the prospective purchaser's experience and expertise in developing the properties similar to the proposed project, and the purchaser's experience and expertise in operating similar projects.
   (c)   Before any real property of the City is offered for sale, the City Council shall make a determination that the property is no longer needed for City purposes and/or that the value of the property to the City is less than the cost to maintain the property.
   (d)   Before any sale of property is final, Council at a regular or special meeting must approve the sales price for the property, regardless of the manner in which it is sold.
   (e)   Severability. If any section, sentence, clause, phrase or work of this section shall be declared invalid for any reason whatsoever, such decision shall not affect the remaining portions of this article which shall continue in full force and effect, and to this end the provisions
of this article are hereby declared to be severable.
