SECTION 43. BOARD OF PARK AND RECREATION COMMISSIONERS.
   By the power granted by Chapter 8, Article 21, Section 1 of the West Virginia Code, as amended, this Charter hereby creates the Board of Park and Recreation Commissioners of the City of Mannington, a public corporate body, with all of the powers, duties and obligations provided for by Chapter 8, Article 21 of the West Virginia Code, as amended. For convenience of reference herein, the Board of Park and Recreation Commissioners of the City of Mannington will be hereinafter referred to as the “Board”.
   The Board is created for the purpose of establishing, constructing, improving, extending, developing, maintaining and operating a City public park and recreation system.
   The Board shall consist of five members, all of whom shall be residents and freeholders of Mannington. Except as hereinafter otherwise provided, each member of the Board shall be appointed by the City Council and will serve for six years and until his successor is appointed and qualified. However, the members of the first Board shall serve for the following terms: Two for terms of six years, one for a term of four years, and two for terms of two years. The terms for the members of the first Board shall begin on the first day of August of the year in which this Charter takes effect, and succeeding terms shall begin on the first day of August of the appropriate years. The members of the initial Board shall be appointed in July of the year when this Charter takes effect and each succeeding member within two months of the date that his term commences. When a vacancy occurs on said Board by reason of death, resignation, change of residence from the City, failure to remain a freeholder of the City, or due to any other cause, the remaining member or members of said Board shall appoint a successor or successors, of if there should be no member left on said Board, the City Council shall appoint successors, and in either event, the appointments shall be for the unexpired term or terms.
   The City Council shall provide and allocate in the annual City budget sufficient funds for the operation of the Board, and provide other assistance, as the Council deems necessary.
   The Board may, in its own name, accept and disburse any funds it may receive by gift, bequest, devise or otherwise for park or recreational purposes. Any money received and accepted by the City of Mannington from any source designated for recreational purposes shall be turned over to the Board for use as intended and shall be accounted for in the annual financial report.
   The Board shall present to the Mayor and Council a copy of the minutes of each of their meetings, within 30 days of each meeting.
   The Board will organize and operate as provided for by Chapter 8, Article 21, of the West Virginia Code, as amended, and other applicable laws.
   The Board of Park and Recreation Commissioners shall be required to have the proper audits conducted, and requested, as provided under West Virginia state law. The Board shall also furnish a yearly financial statement to the City Council in sufficient time to be published with the City of Mannington’s financial statement. The Board shall further furnish any other requested financial statements or information, including audit reports, to the City Council, within thirty days of said additional financial statements or information being requested.
