This title governs the division of land within Gallatin County which is located within the town.
A. Within Town And Outside Town: If a subdivision is located both within the town and outside the town, the division of land is governed both by this title and the Gallatin County subdivision regulations; and shall be reviewed and approved under both.
B. Proposed Annexation: If a subdivision is proposed to be annexed to the town prior to finalization, the subdivision may be governed by this title but must be annexed prior to finalization. The Manhattan town council may combine public hearings and otherwise coordinate the subdivision review process and annexation procedures whenever possible.
C. Outside Town: If a subdivision is located outside of the town but within the jurisdictional area of the Manhattan city-county planning board, the subdivider shall submit the preliminary plat to the Manhattan city-county planning board for review. The advice of the Manhattan city-county planning board shall be forwarded to the Gallatin County commission.
D. This Title Supplements Other Regulations: This title supplements all other regulations, and where they are at variance with other laws, regulations, ordinances, or resolutions, the more restrictive requirements apply. Other regulations include, but are not limited to, zoning regulations, floodplain regulations, building codes, development codes, and fire codes. (Ord. 08-001, 3-11-2008)
