If any owner or occupant of land, buildings or premises abutting an aforesaid street or alley shall fail, refuse or neglect to perform any necessary work required by this chapter, the town shall cause such work to be done and the cost of the construction of the same shall be assessed against such property and the amount thereof shall constitute a lien against such property, and such assessment shall be collected and the lien enforced by suit in the name of the town, or by any officer, contractor to whom it may be directed, that payment be made in any court of competent jurisdiction.
