(A) Trees shall be provided in the margins of both sides of all public or private streets and shall be placed at the minimum rate of 2 per single-family residential lot or at a maximum distance apart of 60 feet. Trees planted on street margins, along village easements or pedestrian ways, shall be placed a minimum of 35 feet apart from each other for deciduous trees and a minimum of 25 feet for ornamental trees. These spacing shall also be applied to trees on street margins, easements, pedestrian ways, including new or existing trees located on private property.
(B) Evergreens shall not be placed on street margins, village easements or pedestrian ways without first conforming to the tree policy established by the Parks Commission and obtaining a permit form the Village Clerk, who shall collect the fee and issue the permit by and with the authority of the Village Council.
(C) All trees to be installed in the street margins, along village easements, pedestrian ways or any other landscaped areas required by this chapter, shall conform to the tree policy established by the Parks Commission.
(D) Trees shall be free of deleterious insects and/or disease. Trees shall be in accordance with the American Association of Nurserymen Standard for Nursery Stock, (1250 I Street, N.W., Suite 500, Washington, D.C. 20005) as to size, form and specimen quality as adopted by the Parks Commission.
(E) No tree of other vegetation shall be maintained on private property which by virtue of disease, damage, or insect infestation presents a hazard to person or vegetation on public property or adjacent private property which would be affected.
(F) Trees and other vegetation on private property shall be maintained so that no part thereof intrudes upon the public easement within the space of 8 feet above the surface of the easement, or in any way restricts pedestrian or vehicular movement. Vegetation on private property within 25 fee of the intersection of easement lines shall not be permitted to grow beyond the height of 36 inches above adjacent easement surfaces. Trees may be maintained within 25 feet of the intersection, but mst have all branches trimmed to provide clear vision for a vertical height of 8 feet above the roadway surface.
