(A) The Planning Commission shall, at the meeting at which the preliminary plat is received from the Village Clerk, establish a date for a public hearing thereon. Notices of public hearing shall be sent by registered mail to the proprietor, to owners of adjoining lands, and the public utility companies serving the area. Notices shall be mailed not less than 15 days prior to the hearing date. The hearing shall be held within 35 days of date on which the Planning Commission receives the preliminary plat from the Village Clerk.
(B) The Planning Commission shall review the preliminary plat for conformance to the General Development Plan and to standards and specifications set forth in the Subdivision Control Act and in this chapter. If the Planning Commission determines that there is substantial conformance, it shall transmit 1 copy of the preliminary plat to the Staff of the County Planning Commission for design review, 1 copy to the Subdivision Advisory Committee for technical review, 1 copy to the Village Engineer for technical review, and 1 copy to the Superintendent of the Manchester Public Schools for information purposes. If there is not substantial conformance the Planning Commission shall return the preliminary plat to the proprietor and shall explain by letter or report, the reasons for the nonconformance.
(C) After holding a public hearing, and after receiving comments and recommendations, if any, from the County Planning Commission Staff, the Subdivision Advisory Committee, the Village Engineer and the Superintendent of Schools, the Planning Commission shall re-evaluate the preliminary plat and may request modifications therein.
(D) The Planning Commission shall tentatively approve or disapprove the preliminary plat within 60 days of the date of filing of the plat. The review period may be extended by written agreement between the Planning Commission and the proprietor, if the Planning Commission does not act within the 60-day period, and if no extension is secured, the Planning Commission's tentative approval of the preliminary plat shall be assumed.
(E) The Village Council shall, within 30 days of receiving the Planning Commission's report, tentatively approve or disapprove the preliminary plat. If approved, same shall be noted on the plat; if disapproved, reasons therefor shall be submitted in writing to the proprietor.
