§ 52.26 STREET OPENING FEE.
   (A)   It is declared and enacted by the City Council that the owners of property receiving water services from the city shall be solely responsible for the payment of a street opening fee whenever a property owner or water user excavates or opens any city street or public right-of-way for the purposes of servicing or making repairs to the owner’s pipes, fixtures and/or property. The street opening fee shall be established by resolution of the City Council.
   (B)   Failure of the owner of the property receiving water services to pay the street opening fee shall be grounds for the Public Works Director to turn off the water services of such property as provided in § 52.21 of this chapter and shall also be subject to such other penalties as provided in this chapter.
