(A) (1) The city’s Public Works Director supervises garbage collection or any of their authorized representatives may order the owner, occupant, tenant, lessee or agent of the owner of any premises upon which there is an accumulation of any rubbish, ashes, garbage or other waste matter to remove the same within a reasonable time if such accumulation is:
(a) Offensive to sight;
(b) In a condition which fosters the propagation of rats or vermin or flies or other insects; or
(c) Otherwise unsanitary, prejudicial or in any manner hazardous to the public health.
(2) Such order shall be made in writing and delivered, whenever feasible, personally to the owner, occupant, tenant, lessee or agent of the owner or, where such personal delivery is not feasible, posted conspicuously at the premises. Such order shall specify a reasonable period within which compliance shall be had.
(B) For purposes of ascertaining violations of this section and investigating complaints made hereunder, whenever reasonable cause for investigation appears, the right of entry onto any premises at a reasonable time to conduct a reasonable inspection or investigation is hereby granted to the city’s Health Officer, the agency in charge of garbage collection or any of their authorized representatives.
(C) In the event that any order lawfully issued in pursuance of division (A) above is not complied with in such reasonable time as is specified, the particular instance of improper accumulation or storage of rubbish, ashes or garbage is hereby declared to be a nuisance and may be summarily abated, at the expense of the violator, by the city’s Health Officer, the agency in charge of garbage collection or any of their authorized representatives.
(D) It shall be unlawful to hinder, prevent or refuse to permit any lawful inspection or investigation authorized in pursuance of division (B) above.
(E) Concrete, fence posts, tires, large pieces of lumber, large tree limbs or large containers of used cooking oil shall not be placed in the city garbage cans. The above items are to be hauled to the city landfill.
