§ 35.01 DEPOSITORIES.
   The First State Bank of Malta, Montana, and the Bank of Malta, Montana, are each designated as an official depository for municipal funds of the city.

FUNDS
§ 35.15 SPECIAL SIDEWALK, CURB AND GUTTER FUND.
   (A)   Created. The City Council hereby creates the “Malta Special Sidewalk, Curb and Gutter Fund”, for the purpose of providing means for the construction of sidewalks, curbs and gutters, or any combination thereof, which may hereafter be constructed by order of the City Council under the provisions of §§ 152.015 through 152.021 of this code of ordinances.

   (B)   Form. An application shall be submitted to Council by an owner(s) of real property located within the city limits. The application must be include a contractor’s invoice stating the cost of the repair/construction of the sidewalk, curbs or gutters requested by the applicant. The city will issue checks from the city’s Sidewalk, Curbs or Gutter Fund to pay the contractor for his or her services. The loans shall bear interest at the rate of 7% per annum, levying an annual assessment and tax against each lot or parcel of land upon which sidewalks, curbs of gutters have been constructed pursuant to the application. The principal and interest on the loan are paid in seven annual equal instalments.

   (C)   Levy of assessment and tax.
      (A)   The City Council shall, annually, and before the first Monday in September of each year, pass and adopt a resolution levying an assessment and tax against each lot or parcel of land in front of which sidewalks, curbs and gutters, or any combination thereof, have been constructed under orders of the City Council, pursuant to §§ 152.015 through 152.021 of this code of ordinances.
      (B)   Said resolution levying such assessments shall be in every manner prepared and certified the same as resolutions levying assessments for the making of improvements in special improvement districts.

   (D)   Delinquent taxes. No checks shall be drawn from said fund for construction of sidewalk, curb and gutters on any lot, parcel or property for which there are owed to the city or any political subdivision of the state any delinquent taxes or assessments.

§ 35.16 CAPITAL IMPROVEMENT PROGRAM FUND.
   (A)   Fund created. The City Council does hereby create the “Malta Capital Improvement Program Fund” for the purpose of replacement and acquisition of property, plant or equipment costing in excess of $5,000, with a life expectancy of five years or more, as authorized by M.C.A. § 7-6-616.

   (B)   Allocation. The City Council, by resolution, determines the purpose of capital improvement program funds and will, by resolution, determine the amount of funds to be allocated to the Capital Improvement Program Fund.

   (C)   Warrants. Warrants drawn against the city’s Capital Improvement Program Fund will be made in the excess of $5,000 for the replacement of property, plant or equipment with a life expectancy of five years or more.

§ 35.17 UNDERGROUND AUTOMATIC LAWN SPRINKLER FUND.
   (A)   Created. The City Council hereby creates the “Malta Underground Automatic Lawn Sprinkler Fund”, for the purpose of conserving water by the construction of underground automatic lawn sprinklers, which may hereafter be constructed by order of the City Council under the provisions of §§ 52.40 through 52.41 of this code of ordinances.

   (B)   Form. An application shall be submitted to Council by an owner(s) of real property located within the city limits. The application must be include a contractor’s invoice stating the cost of the underground automatic lawn sprinklers.
