§ 152.021 SIDEWALK CONSTRUCTION; WIDTH; SLOPE; CONFORMANCE TO EXISTING SIDEWALK REQUIRED; NEW TYPE REQUIRED WHEN NO SIDEWALK PRESENT; CHANGE TO NEW TYPE; APPLICATION REQUIRED.
   (A)   All sidewalks to be constructed in the city after 10-26-1964 shall be of concrete and shall be five feet wide.

   (B)   All sidewalks constructed in the city after 10-26-1964, shall have a slope towards the curb and gutter and such slope shall be one-quarter of an inch to each foot of sidewalk width.

   (C)   (1)   If a sidewalk is presently located in a block in the city and an owner of property in the block does not have a sidewalk located on his or her property and he or she desires to build a sidewalk, the owner must build his or her sidewalk to conform with the sidewalk presently existing in the block; provided that, the existing sidewalk is of the width and has the slope provided in divisions (A) and (B) above.
      (2)   However, the owner may make application to the governing body of the city to construct a “new type” sidewalk, namely a sidewalk adjoining the curb, on a block on which an “old type” sidewalk, namely a sidewalk which does not adjoin the curb, is located and upon receiving such approval shall install such “new type” sidewalk in accordance with divisions (A) and (B) above and shall connect such sidewalk to any existing sidewalks as is required by the governing body in its approval of the application.

   (D)   If there is no sidewalk presently built in a block in the city and owners of property in the block desire to build sidewalks, such sidewalks must be of the “new type”; namely, they must be constructed adjacent to and must join the curb located in the block and must be of the slope and width as provided in divisions (A) and (B) above.

   (E)   If there are sidewalks located in a block in the city and any or all of the owners of property in the block desire to change the construction of the sidewalk to the “new type”; namely, sidewalk adjoining the curb, the owner or owners must make application to the governing body of the city for the change of sidewalk and upon receiving approval of the governing body for the change, the old sidewalk must be removed and a new sidewalk constructed in accordance with the provisions of divisions (A) and (B) above and shall be connected to any existing sidewalks as shall be required by the governing body in its approval of the application.
