§ 152.037 OPENINGS LESS THAN 1,000 SQUARE FEET.
   (A)   (1)   If the opening or openings proposed in such application do not exceed 1,000 square feet, the Director of Public Works or authorized representative may, in his or her discretion, grant or refuse to grant a permit for such work.
      (2)   The refusal of the Director of Public Works or authorized representative to grant any such permission is subject to review by the City Council.
   (B)   (1)   In case a permit is granted to the applicant, the applicant shall accomplish the proposed work within the time allowed by the Director of Public Works or authorized representative and under his or her supervision and shall backfill any such excavation by tamping in six-inch lifts.
      (2)   In the event the proposed opening is in pavement, the surface shall be left in such condition so that the city may repair the pavement by repaving the opening.
      (3)   No tunneling shall be allowed under any street or alley within the city for a distance greater than 15 feet without providing at least one opening to the surface thereof for backfilling. Backfill shall be thoroughly tamped in layers to prevent settlement.
      (4)   Within a reasonable time after the backfilling has been completed in any excavation made in a paved street, the city shall restore the surface thereof.
      (5)   All alley excavation shall be the responsibility of the person, persons, firm or corporation to backfill and tamp as required in this section.
      (6)   All street or alley openings are to be inspected by the Director of Public Works or an authorized representative of the city.
