(A) The Assistant Chief shall perform the duties as may be designated by the Chief from time to time and shall perform the duties of the Chief in his or her absence, which he or she shall relinquish upon the return to duty of the Chief.
(B) At any time the office of Chief of Police or Assistant Chief is filled from any rank in the Police Department the position from which the office of Chief or Assistant Chief is filled shall remain as filled and not open for purposes of promotion by reason of the provision for reversion contained in § 35.03.
