§ 35.03  APPOINTMENT.
   The Board of Fire and Police Commissioners shall appoint ail officers and members of the Police Department, with the exception of the Chief of Police and Assistant Chief of Police. All appointments to the Police Department, other than that of the lowest rank, and with the exception of the Chief of Police and Assistant Chief of Police shall be from the rank next below that to which the appointment is made. The Mayor shall appoint annually, at the first regular meeting of the City Council in May of each year, or as soon thereafter as may be convenient, with the approval of the City Council, to the Office of Chief of Police and to the office of Assistant Chief of Police; he or she may, in his discretion, appoint the Chief of Police and the Assistant Chief of Police from the membership of the Police Department, regardless of rank. Should the Chief of Police or Assistant Chief of Police be appointed from the membership of the Police Department, upon completion of his term of office, he or she shall revert and be returned to the rank held by him in the Police Department at the time of his appointment to the office of Chief of Police or Assistant Chief of Police, provided he or she shall not have been promoted to a higher rank by the Board of Fire and Police Commissioners during the term of office as Chief of Police or as Assistant Chief of Police, in which event he or she shall revert and return to the highest rank to which he or she has been appointed. All of said officers, including the Chief of Police and Assistant Chief of Police, shall be subject to removal as provided by law and the City Ordinances.
