§ 3-5.12 PARADES AND ASSEMBLIES.
   (A)   Article VIII of the Uniform Traffic Ordinance is amended by adding thereto a new section to be designated § 8.10 to read as follows in § 3-5.12(B).
   (B)   Section 8.10. parades and assemblies.
      (1)   Definitions.
         (a)   PARADE. Any march or procession of persons or animals or vehicles, or any combination thereof, except funeral processions over or upon any public street, sidewalk, alley, or other public place, which march or procession does not comply with normal and usual traffic regulations or controls.
         (b)   ASSEMBLY. Any congregation, meeting, or gathering of persons and/or objects upon any public street, sidewalk, alley, or public place so as to obstruct the free passage or use of any such street, alley, sidewalk, or place.
      (2)   No person shall conduct, manage, or participate in any parade or assembly in the city without a written permit therefor having been issued by the Chief of Police.
      (3)   No permit shall be issued authorizing the conduct of a parade or assembly which the Chief of Police finds is proposed to be held for the sole purpose of advertising any product, goods, wares, merchandise, or event and is designed to be held purely for private profit.
      (4)   The Chief of Police shall issue a permit if he or she finds all of the following:
         (a)   That the conduct of the parade or assembly will not substantially interrupt the safe and orderly movement of traffic at the point of assembly or contiguous to a parade route;
         (b)   That the conduct of the parade or assembly will not require the diversion of so great a number of police officers of the city to properly police the area as to prevent normal police protection to the city;
         (c)   That the conduct of the parade or assembly will not interfere with the movement of fire-fighting equipment en route to a fire;
         (d)   That the conduct of the parade or assembly is not reasonably likely to cause injury to persons or property or to provoke disorderly conduct or create a disturbance; and
         (e)   That any such parade will move from its point of origin to its point of termination expeditiously and without stopping en route.
      (5)   The Chief of Police is authorized to impose any and all reasonable conditions to the issuance of any permit required by the provisions of this section to ensure the safety of persons and property.
      (6)   The permit issued by the Chief of Police shall contain its date of issuance, the name of the person or organization applying therefor, the specific event, the conditions of issuance, if any, and, in cases of parades, the route and starting time.
      (7)   The Chief of Police shall act upon the application for a parade or assembly permit within 30 days after the filing thereof. If the application is denied, the Chief of Police shall mail to the applicant within 30 days after the filing of the application for the permit a notice of this action, stating the reasons for the denial of the permit. Any person desiring to appeal from such decision may do so in the manner set forth in Chapter 4 of Title 1 of the City Municipal Code.
