§ 130.99  PENALTY.
   (A)   Any person 17 years of age or older found to be in violation of § 130.02 shall be subject to a fine of not less than $500 and not more than $750 for each violation thereof. Any person under the age of 17 who violates § 130.02 shall pay court cost, and in addition to paying the fine, shall complete not less than 20 hours of community service. Any person 17 years of age or older who violates § 130.02 may, in addition to paying the above fine, be sentenced to not more than six months’ incarceration. Notwithstanding age, any individual found in violation of § 130.03 must complete drug counseling.
   (B)   Any person 17 years of age or older found to be in violation of § 130.03 shall be subject to a fine of not less than $100 and not more than $750 for each violation thereof. Any person 17 years of age or older who violates § 130.03 may, in addition to paying the above fine, be sentenced to not more than 30 days incarceration. Notwithstanding age, any individual found in violation of § 130.03 must complete drug counseling. Any person under the age of 17 who violates § 130.03, in addition to drug counseling shall only pay court cost.
   (C)   Each violation of this chapter, or everyday a violation continues to exist, shall constitute a new and separate violation.
