§ 112.39 PREMISES.
   (A)   All walls, floors, ceilings, and all procedure surfaces of a body art establishment shall be smooth, non-absorbent, free of open holes or cracks, light colored, washable, and in good repair. Walls, floors, and ceilings shall be maintained in a clean condition. All procedure surfaces, including client chairs/benches shall be of such construction as to be easily cleaned and sanitized after each use. All body art establishments shall be completely separated by solid partitions or by walls extending from floor to ceiling, from any room used for any unrelated activity such as a food establishment or room where food is prepared, a hair salon, tanning facility, retail sales, or other such activity which may cause potential contamination of work surfaces.
   (B)   Effective measures shall be taken by the practitioner to protect against the entrance into the establishment, and against the breeding or presence on the premises, of insects, vermin, and rodents. Insects, vermin, and rodents shall not be present in any part of the establishment.
   (C)   Each establishment shall have an area that may be screened from public view for clients requesting privacy. Dividers, curtains, or partitions shall separate multiple body art stations.
   (D)   The establishment shall be well-ventilated and provided with an artificial light source to maintain adequate light for cleaning and body art procedures.
   (E)   A separate hand sink with hot and cold running water, under pressure, equipped with touch-less controls and readily accessible within the body art procedural area shall be required in all newly constructed body art establishments. One hand sink shall serve no more than three operators. All hand sinks shall be supplied with liquid soap, and disposable paper towels, in addition, there shall be a minimum of one readily accessible lavatory, excluding any service sinks, and one toilet in a body art establishment.
   (F)   At least one covered waste receptacle shall be provided in each body art procedure area and each toilet room. All refuse containers shall be easily cleanable.
   (G)   All instruments and supplies shall be stored in clean, dry, and covered containers.
   (H)   No animals of any kind shall be permitted in a body art establishment except service animals used by persons with disabilities or fish aquariums in waiting rooms and non-procedural areas.
