12-11-13: SIGNS IN COMMERCIAL ZONES 1 :
No signage is allowed in commercially zoned areas except as follows and which are for those services only if properly allowed and legally offered on the premises. However, a permit is required as explained in section 12-11-5 of this chapter. (1965 Code § 7-9-24)
   A.   Prohibited Signs:
      1.   Advertising Benches 2 : It shall be unlawful for any person to construct, locate or maintain any bench or seat used in whole or in part for the purpose of advertising or for the use as a commercial signboard or billboard (hereinafter collectively referred to as "advertising benches") located in or on any public sidewalk or other public land or property owned by the village. Bus stops, as authorized by the village, shall be exempt from this provision.
      2.   Signs Advertising Products: Permanently affixed signs or painted wall signs for the sole purpose of advertising a product are prohibited.
      3.   Billboards: All billboards (outdoor advertising poster panels) are prohibited 3 .
      4.   Projecting Signs: It shall be unlawful to erect any projecting sign that extends from the wall of a building upon which it is erected.
      5.   Roof Signs: Roof signs shall not be permitted.
      6.   Nonconforming signs are prohibited.
      7.   Pole signs are prohibited.
      8.   Pylon signs are prohibited.
   B.   Awning Or Canopy Signs:
      1.   An "awning or canopy sign" is any sign painted on or applied to the surface of an awning or canopy.
      2.   The maximum height from the bottom of the sign to the top will be five (5) linear feet.
      3.   The maximum surface display area of the sign will be one hundred (100) square feet.
      4.   There shall be established a minimum of eight feet (8') of clearance from ground level to the lowest element of the awning or canopy.
      5.   Neither the body of the awning or canopy nor its supports shall be allowed to project more than five feet (5') from the wall of any building; however, in no case shall such projection be permitted to infringe on any adjacent lot, parcel or tract.
      6.   Lettering, characters, symbols, numbers, trademarks and the like appearing on the body or apron of an awning or canopy shall not exceed eighteen inches (18") in height.
      7.   The top of any awning or canopy, including its structural elements, shall be no higher than the height of the building or fifteen feet (15') above grade, whichever is lower.
   C.   Barber Poles: Nothing contained in this chapter shall prohibit or restrict on premises barber poles. (1965 Code § 7-9-24)
   D.   Building Markers: Memorial signs or tablets, names of buildings and date of erection when cut into any masonry surface or when constructed of bronze or other incombustible materials shall be permitted. Signs less than four (4) square feet require no permit. Maximum size allowed is eight (8) square feet. (1965 Code § 7-9-24; amd. 2009 Code)
   E.   Bulletin Boards; Freestanding Signs: A freestanding bulletin board shall be set back a minimum of fifteen feet (15') from the street right of way. No freestanding bulletin board shall exceed twenty (20) square feet in display surface area. (1965 Code § 7-9-24)
   F.   Collection Boxes For Charitable Or Nonprofit Organizations: Collection boxes for charitable or nonprofit organizations containing no commercial advertising and located on private nonresidential property shall be permitted. However, collection boxes must be maintained in a safe, healthy and reasonable manner. These are allowed without a permit.
   G.   Directional, Identification And Informational Signs: Directional, identification and information signs shall be permitted, provided such signs shall be limited to wall or freestanding signs with a maximum of six (6) square feet of display surface area. One informational sign shall be permitted at each entrance or exit on a lot or parcel to identify said entrance or exit, provided such sign does not constitute a traffic hazard.    H.   Festoon Lighting: Festoon lighting is prohibited in all zoning districts except for the following:
      1.   Permitted for special community and civic events as well as special anniversary, birthday, etc., or other parties held by a business or resident.
      2.   For special sales promotions outside, such as pumpkin or Christmas tree sales.
   I.   Freestanding Signs: It shall be unlawful to erect any freestanding sign which total height is greater than twenty feet (20') above the level of the street upon which the sign faces. Freestanding signs shall be permitted to be erected in the city, subject to the following:
      1.   Off site freestanding signs are prohibited.
      2.   On site freestanding signs are subject to the following:
         a.   Only one on site freestanding sign shall be permitted on a lot, except when the business, multiple use building or shopping center has more than four hundred (400) linear feet of frontage, then two (2) freestanding signs may be used.
         b.   Permitted sign display surface shall be computed as follows:
            (1)   Seventy five percent (75%) (3/4) of a square foot for each linear foot of lot frontage, with a minimum surface display area on the sign of twenty (20) square feet and not to exceed the maximum surface display area of one hundred (100) square feet.
            (2)   Sign shall be permitted in front yards only. No freestanding business sign may be erected on, over, or within five feet (5') of any public right of way. A freestanding sign may, however, be located to a point equal to the boundary line between the property and a public sidewalk, provided such placement is not a nuisance or a hazard.
            (3)   The street address of the place of business advertised must be placed somewhere on the sign with letters approximately three and one-half inches (31/2") in height that can easily be seen by a motorist.
            (4)   The lowest part of the sign shall be twelve feet (12') from the surface of the sidewalk or public way.
            (5)   The total height of the sign shall not exceed twenty feet (20').
   J.   Fuel Price Informational Signs: In a properly zoned district, signs advertising the price of motor vehicle fuel sold from a fuel pump located on the premises shall be permitted, subject to the following conditions:
      1.   Only one fuel price informational sign shall be permitted per fuel pump.
      2.   Fuel price informational signs shall be limited in size to an area of two hundred sixteen (216) square inches.
      3.   Each fuel price informational sign shall be affixed directly and firmly to a fuel pump and shall be stationary.
      4.   One freestanding sign to include a changeable copy sign/reader board is allowed. The size of the freestanding sign shall be determined by using eight (8) square feet per pump with a total of forty eight (48) square feet maximum allowed. The maximum size sign is to include company name, logo, price information, etc., if applicable.
      5.   Two (2) tire racks for the purpose of displaying new tire casings shall be permitted for each gasoline or service station. Such racks shall only advertise the product(s) contained thereon. Such racks must be enclosed after the closing of business.
      6.   Nothing contained herein shall be construed to prohibit the use of other signs meeting the requirements of this chapter.
   K.   Marquee Signs: A marquee sign is one that has changeable or movable letters. It is usually a freestanding sign, but can be a wall mounted box sign. The following provisions will apply:
      1.   The size of the sign shall be computed by allowing seventy five percent (75%) of a square foot for each linear foot of lot frontage, with a minimum surface display area on the sign of twenty (20) square feet and not to exceed the maximum surface display area of one hundred (100) square feet.
      2.   The sign will be no more than twenty feet (20') in overall height from the level street grade.
      3.   The sign will be no more than five (5) linear feet from the bottom of the sign surface area to the top.
   L.   Outdoor Menu Boards: Outdoor menu boards are only allowed on zone lots which have previously been approved for restaurants with drive-through windows and under the following conditions:
      1.   Only one outdoor menu board shall be permitted, per order window, on a lot.
      2.   Display surface area shall not exceed thirty two (32) square feet.
      3.   Stacking lane (drive-through lane) shall be a minimum of eighty feet (80') from the menu board.
      4.   If the sign is lighted, it may be lighted by an illuminated sign only.
      5.   The outdoor menu board lettering may not be legible from any distance off the zoned lot for which it is approved.
   M.   Wall, Box Or Individual Letter Signs:
      1.   Box type wall signs shall not project more than eighteen inches (18") from the surface upon which they are mounted, provided the upper edge of the wall sign which is mounted on a mansard roof may project more than eighteen inches (18") so long as the sign is perpendicular to the ground.
      2.   Where a building houses more than one business, wall signs shall be limited to one wall sign per business on each wall, with a limit of two (2) wall signs per business per building.
      3.   Permitted box sign surface display area will be computed as follows:
         a.   One and one-half (11/2) square feet allowed for each linear foot of building frontage.
         b.   Maximum size of surface display area of a box sign will be one hundred (100) square feet.
         c.   Maximum height of sign will be twenty feet (20').
      4.   Individual letter sign shall be computed as follows:
         a.   Two (2) square feet allowed for each linear foot of building frontage.
         b.   Maximum size of area, measuring from the four (4) corners in a square or rectangle from the edges and from the highest characters, will be one hundred twenty five (125) square feet.
      5.   All illuminated signs must be equipped with an outside electrical disconnect.
      6.   Painted wall signs shall not exceed one hundred sixty (160) square feet.
   N.   Window Signs:
      1.   Signs painted on or affixed to glass surfaces of windows or doors are permitted in commercial districts if they pertain to the lawful business conducted therein. These signs are allowed without a permit.
      2.   Nonilluminated temporary sale signs shall be permitted, and these signs are allowed without a permit.
      3.   The total of all window identification and window promotional signs shall not exceed fifty percent (50%) of the total area of the windows in which they are located. A series of windows which are separated by frames and supporting material less than six inches (6") in width shall be considered as a single window for the purposes of computation.
   O.   Banners: Sale or party banners shall be removed within forty eight (48) hours following the event to which the banner applies. Sale banners can only have a duration of fourteen (14) days in any one calendar month. Party banners can only have a duration of thirty (30) days in any one calendar month. (1965 Code § 7-9-24)
   P.   Temporary Commercial Signs: An A-frame, portable swinger, sandwich, or mobile attraction signboard containing a commercial message may be placed temporarily on site to promote a grand opening, special event, or special service on the premises where the sign is located. Such a temporary commercial sign shall require a permit from the village in accordance with section 12-11-5 of this chapter.
      1.   No temporary commercial sign shall be located off site.
      2.   No temporary commercial sign shall be attached to fences, trees, utility poles, or the like and shall not be placed so as to obstruct or impair vision or traffic or in any manner to create a hazard to pedestrian or vehicle traffic.
      3.   Temporary commercial signs shall be located a minimum of five feet (5') from any curb or edge of pavement.
      4.   Temporary commercial signs shall not exceed sixteen (16) square feet in area and shall have a height no greater than six feet (6') above the ground surface.
      5.   No temporary sign shall be illuminated.
      6.   A temporary commercial sign may be displayed only for the duration of the grand opening, special event, or special service that the sign is promoting, but in no case shall a temporary commercial sign be displayed longer than thirty (30) consecutive days.
      7.   No more than one such temporary commercial sign shall be permitted for the grand opening, special event, or special service that the sign is promoting for each seventy five feet (75') of frontage. (1965 Code § 7-9-24; amd. Ord. 07-21-09-01, 7-21-2009; Ord. 08-03-21-01, 8-3-2021)
