12-4-2: AMENDMENTS TO BUILDING CODE:
The following sections of the International Building Code adopted in section 12-4-1 of this chapter are hereby revised as follows: (1965 Code § 7-1-2; amd. 2009 Code)
Section 101.1: Insert: village of Lyons.
Section 105.2: Delete "permits shall not be required for the following" and all listed items successive to that sentence.
Section 105.5: Delete existing language. Refer to title 12, chapter 2 of the village code for permit regulations.
Section 107.3: Replace "ICC electrical code" with "current village of Lyons electrical code".
Section 109.5: Add: In the event a property owner, permit holder, or his authorized agent, upon proper notice by the village, fails to comply with an inspection request as noticed, or fails to obtain required or final inspection approvals, the property owner, permit holder or his authorized agent shall be in violation of this code and subject to the penalties therein.
Section 110.4: Add: The building director is also authorized to suspend or revoke a certificate of occupancy or completion in the event that conditions of the certificate are violated.
Section 112.3: Shall be deleted and the following substitute language inserted: "Qualifications. The building board of appeals shall consist of five (5) individuals, one from each of the following professions or disciplines:
      1.   A registered architect or engineer.
      2.   An electrical engineer or licensed electrical contractor.
      3.   A plumbing engineer or licensed plumbing contractor.
      4.   An HVAC engineer or licensed HVAC contractor.
      5.   A licensed general contractor or municipal building inspector.
      6.   A current building or trade inspector for another Illinois jurisdiction.
Each of the above members shall have no less than three years' experience in their respective disciplines. No member shall be a current inspector for the village of Lyons. If a member of one or more of the above disciplines is not available for appointment to the board, members may be appointed from the other listed disciplines."
Section 115.4: Amend (c) to read: "By regular mail;"
   Add: "For purposes of this code, notice to the owner shall also be deemed effective upon notification to the taxpayer of record, as enumerated in the records of the Cook County assessor's office, or, the Lyons Township assessor's office."
Section 115.6: Add new section 115.6: "The code enforcement officer is hereby authorized and empowered to order and require the occupants of an unsafe building or structure to vacate same as may be required by the code enforcement officer. When prohibiting occupancy, the code enforcement officer shall cause to be posted at each entrance to such buildings or structures a notice reading substantially as follows: "This structure is Unsafe and its Occupancy has been Prohibited by the Code enforcement officer". It shall be unlawful for any person to enter such structure except as authorized by the code enforcement officer, who may promulgate rules regarding the entry of such structures for the purposes of abating the violations" 1 .
Section 116: Add new section 116, entitled "Other Amendments". The section shall be worded as follows:
   116.1 Multi-family dwellings in the village of Lyons shall be of a decorative brick or masonry type construction. All multi-family buildings containing more than three units shall be fully sprinkled in compliance with the technical requirements of this code and that of the NFPA life safety code, 2000 edition, or its successor as adopted by the village of Lyons.
   116.2 New structures, regardless of their use and in excess of 5,000 square feet of floor area (cumulative, including basement and all stories), or in excess of 5,000 square feet of building area, shall have a fire sprinkler, smoke detection and alarm system in compliance with the technical requirements of this code and that of the 2000 NFPA life safety code, or its successor as adopted by the village of Lyons.
   116.3 Where provisions of this code conflict with any other adopted code of the village of Lyons, the stricter standard shall apply.

   116.4 Add new subsection 102.7. The primary building code for the construction, modification and alterations of one and two-family dwellings shall be chapters 2 through 43 of the 2006 international residential code. The administrative section of the 2006 international building code shall be the administrative section for the 2006 international residential code.

   116.5 In addition to providing legal representation for all village of Lyons officials in conjunction with claims made in regard to the adoption and/or enforcement of this code, the village shall indemnify such official for liabilities incurred hereunder.
