2.02.05: APPEALING REPRISALS OR RETALIATORY ACTION AND OTHER VIOLATIONS OF THIS CHAPTER:
If an alleged violation of this Chapter occurs or if any alleged reprisal or retaliatory action is taken against an officer or employee for the disclosure of improper governmental action within two (2) years of such disclosure, the aggrieved officer or employee (hereinafter "the appellant") may file an appeal. The appellant must deliver this appeal in writing to the Lyon County Manager within sixty (60) days of the alleged violation of this Chapter or the alleged reprisal or retaliatory action. The appeal must state, with specificity:
   A.   All facts and circumstances pertaining to the improper governmental action, including, without limitation, when, where, and how the improper governmental action occurred, the individual(s) involved, and any laws, regulations, codes, or ordinances alleged to have been violated.
   B.   All facts and circumstances pertaining to the disclosure of the improper governmental action, including when, where, how, and to whom the information was disclosed.
   C.   All facts and circumstances pertaining to the alleged violation of this Chapter or alleged reprisal or retaliatory action, including, without limitation, when, where, how, and by whom the alleged violation of this Chapter or alleged reprisal or retaliatory action was committed.
Lyon County will provide on its website a form on which officers and employees may submit an appeal containing the information set forth above. Copies of all relevant documents, videos, or other physical evidence in the appellant's custody or control shall be submitted with the appeal. In the event an appeal submission is incomplete or otherwise deficient, the County Manager may, within five (5) days, provide the appellant with written notice of any deficiencies and afford the appellant no less than fourteen (14) days to correct them.
Failure to comply with any deadline in this Section may result in denial of the appeal. (Ord. 546, 2-17-2011; amd. Ord. 612, 5-7-2020)
