9.03.02: DEFINITIONS:
When used in this chapter, the following terms shall have the meanings defined below:
AGENT: A duly authorized individual to act for the legal owner. Agents are required to have notarized authorization from the legal owner if owner is not present.
APPLICANT: The person, firm, association, corporation or governmental agency applying for water service.
APPLICATION: The written request on a form provided by LCUD for water service as distinguished from an inquiry as to the availability or charges for such service.
AVERAGE MONTH: Thirty (30) days.
BILLING PERIOD: The regular billing period will be monthly or at the discretion of the LCUD.
BOARD: The Lyon County board of county commissioners.
BUILDING: Any structure used for human habitation or a place of business, recreation or other purpose containing water facilities.
CAPACITY RATIO: The relative flow of each water service line size as compared to that of a three-fourths inch (3/4") service.

CONNECTION - SUPPLY LATERAL: The pipeline and appurtenant facilities such as the curb stop, meter, meter box and piping all used to extend water service from a main to premises. Where services are divided at the curb or property line to serve several customers, each such branch service shall be deemed a separate service connection.
CONTRACTOR: An individual, firm, corporation, partnership or association duly licensed by the state of Nevada and approved by LCUD to perform the type of work to be done under the permit.
COST: The cost of labor, material, transportation, supervision, engineering, and all other necessary overhead expenses.
COUNTY: The county of Lyon.
COUNTY MANAGER: The county manager of Lyon County.
CROSS CONNECTION: Any physical or potential connection between the piping system from the LCUD service and that of any other water supply that is not, or cannot be, approved as safe and potable for human consumption, whereby water from the unapproved source may be forced or drawn into LCUD distribution mains.
CUSTOMER: In the case of single-family or individually metered multiple-family residences, the customer shall be the owner of the property served, but the billing for service may be sent to the owner in care of his agent or renter. For commercial services, the person in whose name service is rendered, as evidenced by the signature on the application or contract for that service, or in the absence of a signed instrument, by the receipt and payment of bills regularly issued in his name regardless of the identity of the actual user of the service.
DATE OF PRESENTATION: The date upon which a bill or notice is mailed or postmarked or delivered to the customer by LCUD.
DESIGNATED PROPERTY MANAGER: That individual or business entity so designated by the owner to act on his/her behalf.
DIRECTOR: The person appointed by the county manager in accordance with title 1, chapter 7 of this code to perform the duties of utilities director.
ENGINEER: The engineer appointed and acting for LCUD and shall be a registered civil engineer in the state of Nevada.
FIXTURE UNIT: As defined in the latest edition of the uniform plumbing code, International Association of Plumbing and Mechanical Officials as adopted by Lyon County.
FLAT RATE SERVICE: An unmetered water service.
HOUSE PIPING: All piping and fittings installed within the house or building up to and including the last fitting on the outside of an exterior wall.
INSPECTOR: That person so designated by the utilities director to perform inspections, tests, fixture unit counts, and related work in determining compliance with LCUD construction specifications, standards and ordinances.
LCUD: The Lyon County utilities department acting through its duly authorized officers or employees within the scope of their respective duties. May also be used to mean service provider for another service area.
LAW: Any statute, rule, ordinance, bylaw or regulation established by federal, state, county, or municipal authorities.
LIVING UNIT: Any residence, apartment, habitation or other structure to be occupied by a single person or family requiring water service.
MAIN: A water line in a street, highway, alley or easement used for public and private fire protection and for general distribution of water.
MAIN EXTENSION AND/OR CAPACITY ENHANCEMENT: The extension or replacement of water distribution mains and necessary facilities beyond existing service facilities in accordance with the provisions of this chapter applicable to main extensions and/or capacity enhancements.
METERED SERVICE: A service for which charges are computed on the basis of measured quantities of water, sewage, or liquid wastes.
OWNER: The person owning the property, or the person in whose name the legal title to the property appears, by deed duly recorded in the county recorder's office, or the person in possession of the property or building under claim of, or exercising acts of ownership over same for himself, or as executor, administrator, guardian or trustee of the owner.
PERMANENT SERVICE: A service which, in the opinion of LCUD, is of a permanent and established character. The use of water may be continuous, intermittent or seasonal in nature.
PERMIT: Any written authorization required pursuant to this or any other regulation of LCUD for the installation of any waterworks.
PERSON: Any individual, partnership, corporation, governmental agency, or other organization operating as a single business entity.
PREMISES: All that real property of a single integrated operation under one name which operation may involve one or more buildings, locations or services, provided: a) such buildings, locations, or services are to a single unit of property; or b) such buildings, locations or services that are on two (2) or more units of property immediately adjoining, except for intervening public highways, streets, alleys, or waterways.
PRIVATE WATER SYSTEM: Any system served water by LCUD under the responsibility of others for ownership and maintenance.
REGULAR WATER SERVICE: Water service and facilities rendered for normal domestic, commercial and industrial purposes on a permanent basis, and the water available therefor.
SERVICE CLASSIFICATION: Shall be defined as follows:
Commercial Service: Service to customers engaged in selling, warehousing, or distributing a commodity, in some business activity, or in a profession, or in some form of economic or social activity (offices, stores, clubs, schools, hotels, etc.) and for purposes that do not come directly under another classification of service.
Domestic Service: Service to a residential customer.
Industrial Service: Service to customers engaged in a process which creates or changes raw or unfinished materials into another form or product (factories, mills, machine shops, pumping plants, etc., i.e., in extractive fabrication or processing activities).
Irrigation Service: Service to customers for agricultural, floricultural or horticultural use.
Multi-Family Residential Unit: The place of residence of a single family within a multi-unit complex. The family premises and the service thereto, whether a separate building, multiple buildings, a townhouse, an apartment, a mobile home, a condominium or any other type of living unit, and the supporting services for a single family.
Private Fire Protection Service: Water service and facilities for building sprinkler systems, hydrants, hose reels and other facilities installed on private property for fire protection and the water available therefor.
Public Fire Protection Service: Water service and facilities of the entire water supply, storage and distribution system of LCUD, including the fire hydrants affixed thereto, and the water available for fire protection, excepting house service connections and appurtenances thereto.
Single-Family Residential: A single-family residential customer and the services for residential purposes to a single-family dwelling, the residential portion of a building, an individual apartment, a condominium, a mobile home, a multiple dwelling or the portion thereof occupied as the home, residence or sleeping place for one or more persons.
   A. This service classification can include a family operated business within or part of the family residence, and the supporting services to the family residence, and the supporting services to the family residential customer on the same unsubdivided premises as the family residential unit. The fixture unit count for these services shall be added to the single-family unit in determining connection charges and water rights requirements.
SERVICE CONNECTIONS: The point of connection of the customer's piping with LCUD's facilities which is most commonly the connection point on the discharge side of the meter pit or curb stop valve. Where the meter is located other than at the property line, the private water system from the corp valve on the main shall be maintained by the owner of the property.
SERVICE SIZE FOR BILLING PURPOSES: Water service billing is based on a single meter size even when compound meters are used. The water service for billing purposes is based on the calculated demand using the methods based in the uniform plumbing code or from standard engineering practice and correlated to a standard meter flow rate capacity. This calculated service size for billing purposes may vary from the actual meter size installed. Certain site conditions necessitate the installation of a larger meter than required by the flow capacity. Billing will be based on the calculated flow capacity for that connection.
STREET: Any public highway, road, street, avenue, alley, way, public place, public easement or right of way.
TEMPORARY WATER SERVICE: Water service and facilities rendered for construction work and other uses of limited duration, and the water available therefor.
UTILITIES SUPERINTENDENT: The person appointed to superintend the water and sewer works.
WATER DEPARTMENT: The board of commissioners of Lyon County performing functions related to LCUD's water service, together with the county manager, utilities director, utilities superintendent, utilities engineer and other duly authorized representatives.
WATER SUPPLY SYSTEM - PRIVATE SERVICE LINE: All piping between the house piping and the service connection as described in the definition of "service connections" in this section.
WATER WASTE: The negligent or wasteful discharge of water from a hose, sprinkler head, irrigation pipe, water main, indoor and outdoor plumbing fixtures and/or water service, which is flowing into a street, roadside ditch, storm drain, driveway, adjacent property and/or sidewalk creating puddles, streams of water or flooding as further described in subsection 9.03.07B and section 9.03.16 of this chapter.
WILL-SERVE LETTER: A letter written by LCUD at the request of an applicant with respect to a single residential unit, subdivision, commercial or multi-family residential project to confirm: a) that the subdivision or project is within LCUD's boundaries and b) that, if water is available and deeded to Lyon County to serve the proposed connection(s) at the time service is requested under the standards set forth in section 9.03.05 of this chapter, LCUD is willing to provide water service thereto upon compliance with all LCUD requirements and payment of all applicable LCUD fees and charges.
