7.03.02: POSSESSION OR CONSUMPTION OF LIQUOR:
   A.   Possession: It is unlawful for any person under the age of twenty one (21) years to have in his possession any container including, but not restricted to, any can, bottle or jug or other receptacle containing alcoholic beverages including, but not restricted to, spirituous, malt or fermented liquors or wines.
The possession of alcoholic beverages by any person under the age of twenty one (21) does not include the following types of possession:
      1.   Possession for an established religious purpose;
      2.   Possession in the presence of the person's parent, spouse or legal guardian who is twenty one (21) years of age or older;
      3.   Possession in accordance with a prescription issued by a person statutorily authorized to issue prescriptions; or
      4.   The selling, handling, serving or transporting of alcoholic beverages by a person in the course of his lawful employment by a licensed manufacturer, wholesaler or retailer of alcoholic beverages.
   B.   Consumption: It is unlawful for any person under the age of twenty one (21) years to consume an alcoholic beverage, including but not restricted to, spirituous, malt or fermented liquors or wines.
The consumption of alcoholic beverages by any person under the age of twenty one (21) does not include the following types of consumption:
      1.   Consumption for an established religious purpose; or
      2.   Consumption in accordance with a prescription issued by a person statutorily authorized to issue prescriptions.
   C.   Violation: Any person violating the terms of this section is guilty of a misdemeanor. (Ord. 493, 8-4-2005, eff. 8-25-2005)
