9.03.10: DISCONTINUANCE OF SERVICE:
   A.   For Nonpayment Of Bills When Not Collected On Tax Rolls: A customer's service may be discontinued for nonpayment of a bill for service furnished if the account becomes delinquent, provided LCUD has given the customer at least two (2) days' prior written notice of such intention.
   B.   Liability For Bills: Failure to receive a water bill does not relieve consumer or owner of liability. Any amount due shall be deemed a debt to LCUD, and any person, firm, or corporation failing, neglecting or refusing to pay said indebtedness shall be liable to an action in the name of LCUD in any court of competent jurisdiction for the amount thereof.
   C.   Resumption Of Service Charge: Where service has been discontinued for violation of these rules or for nonpayment of bills, the cost of discontinuing and resuming service shall be at the expense of the customer or owner.
      1.   Made During Regular Business Hours: LCUD will endeavor to resume service during regular business hours on the day of the request, if conditions permit; otherwise, LCUD will endeavor to resume service on the next regular business day following the day the request is made.
      2.   Made At Other Than Regular Business Hours: When a customer has requested that the service be resumed at a time outside of regular business hours, LCUD will reasonably endeavor to resume service if practicable under the circumstances but will be under no obligation to do so, unless an emergency exists. A charge based on costs, including overtime rates, shall be billed to the customer for services rendered outside of regular business hours.
      3.   Presence Of Owner Or Authorized Representative: During requested resumption of service, the owner or their authorized representative is required to be on site. (Ord. 504, 1-18-2007)
   D.   Unsafe Apparatus: Water service may be refused or immediately discontinued to any premises where apparatus or appliances are in use which might endanger or disrupt the service to other customers in any way. Where service has been disconnected due to an unsafe apparatus, all costs associated with investigating, discontinuing and resuming service shall be at the expense of the customer.    E.   Cross Connections: Water service may be refused or discontinued to any premises where a cross connection exists that is in violation of this chapter or state, federal or local laws.
   F.   Fraud Or Abuse: Service may be immediately discontinued if necessary to protect LCUD against fraud or abuse.
   G.   For Noncompliance With Rules: LCUD may discontinue service to any customer for violation of these rules after it has given the customer at least five (5) days' written notice of such intention. In case of emergency, unauthorized use, water waste, or where safety of water supply is endangered, service may be discontinued or curtailed immediately without notice, in addition to any other penalties provided by law and these regulations.
   H.   Abatement: During the period of discontinuance of service, habitation of such premises by human beings shall constitute a public nuisance, whereupon the county manager shall cause proceedings to be brought for the abatement of the occupancy of said premises by human beings. In such event, a reasonable attorney fee shall become due as a penalty for nonpayment.
   I.   Customer's Request For Discontinuance Of Service: A customer may have service discontinued by giving not less than two (2) working days' advance notice, in writing, to LCUD. Water base rates shall only be ceased for "seasonal offs" lasting more than one billing period. Base fees for partial months in seasonal off status will not be prorated. When the water is turned back on, either the owner or agent must be present or the owner must provide LCUD with written authorization to resume service without an owner representative being present. LCUD will not be responsible for damage caused from leaking or damaged plumbing.
   J.   Charges For Discontinuing And Resuming Service: Charges shall be made for discontinuing and resuming service, as determined by the board.
      1.   When a discontinuance or resumption of service is made at other than regular business hours, the charge for that service shall be actual cost to LCUD, or at the rate established by the board.
      2.   If the use of equipment is necessary in discontinuing or resuming a service, the customer shall be billed at an hourly rate on a time and materials basis, in addition to the charge for the discontinuance or resumption of service.
      3.   Service shall be considered to be disconnected when an employee of LCUD has been dispatched for that purpose, and the rates, as established by the board, will apply.
      4.   If an unauthorized connection is made to a public water system, the owner or applicant will be charged a fee on a time and materials basis associated with disconnection. Jumpers will be confiscated by LCUD and the owner or person making the connection may be prosecuted under Nevada Revised Statutes 704.800.
