9.03.04: WATER DEPARTMENT:
   A.   Creation: A water department is hereby created comprised of the board of commissioners, county manager and utilities director.
   B.   County Manager: The county manager shall have full responsibility for the maintenance, operation and construction of the waterworks and system in accordance with title 1, chapter 7 of this code.
   C.   Utilities Director: The position of utilities director is hereby created. He/she shall have charge of the utilities of LCUD. This shall include all maintenance, operation and construction of the water and sewer works, and the billing for and collecting the charges herein provided. He/she shall perform such other duties as shall be determined by the county manager in accordance with title 1, chapter 7 of this code.
   D.   Inspections: LCUD shall perform inspections on all public water and sewer construction within LCUD's service area to assure compliance with LCUD standards and specifications. All existing residential, commercial and industrial establishments are subject to inspection for proper operation of backflow prevention, cross connection control, investigation of potential water waste and pressure regulating devices. Inspections shall be scheduled with the property owner or property manager. If the property owner or property manager refuses access, subsection F of this section shall apply.
   E.   Performance Of Duties: The foregoing duties of the utilities director may be performed by the utilities superintendent or by a designated employee or employees, as the county manager in accordance with title 1, chapter 7 of this code may direct, so long as those decisions or actions that require professional engineering judgment are performed by a registered professional engineer.
   F.   Consequences Of Denial Of Entry Or Access: Where an owner or user, after having received reasonable notice from LCUD refuses to permit properly identified LCUD personnel to enter or have access to premises or facilities in accordance with the above sections, LCUD may forthwith give written notice of its intent to terminate water and/or sewer service to such user. Such notice shall be given in accordance with sections 9.03.09, "Billing", and 9.03.10, "Discontinuance Of Service", of this chapter, and termination based on these sections shall be treated as a termination for refusal of access under this section.
   G.   Violation: Any person found to be violating any provision of this chapter or any ordinance, rule or regulation of LCUD, shall be served by the LCUD with written notice stating the nature of the violation and providing a reasonable time limit for the satisfactory correction thereof. The offender shall, within the period of time stated in such notice, permanently cease all violations. The owner shall be held strictly responsible for any and all acts of their agents, renters or employees done under the provisions of this chapter or any other ordinance, rule or regulation of LCUD.
      1.   Amounts: Violations of these regulations shall be subject to civil monetary penalties established by: a) applicable Nevada statutes or administrative code, b) Nevada division of environmental protection and Lyon County and c) by such penalty schedules as may from time to time be adopted by the board of commissioners.
      2.   Continuing Violations: For purposes of the computation of penalties, each day of a continuing violation of these regulations shall be deemed to be separate violation.
   H.   Water Pressure And Supply: LCUD assumes no responsibility for loss or damage due to lack of water or pressure fluctuations, either high or low, and merely agrees to furnish such quantities and pressures as are available in its general distribution system. LCUD will endeavor to give reasonable notice to customers before a curtailment of services; however, LCUD shall not be liable for shutdowns or variations in pressures or water quantities that occur without prior notice by LCUD.
