§ 113.02 TRAINING PROGRAM CERTIFICATION.
   (A)   All sellers and retailers of alcoholic beverages, as defined in KRS Chapters 241 to 244 and KAR Chapters 1 to 11, in the city must be certified in the training program established and certified by the local ABC Authority, or one approved through the local ABC authority. It is the responsibility of the above-defined seller or retailer to insure employees who handle the sale and service of alcoholic beverages maintain certification. Newly hired personnel will be given 45 days to obtain their certification. Certification shall be renewed every three years from the date of program completion. Certification for the sellers or retailers shall be as follows:
      (1)   Those sellers or retailers holding only a retail beer or package liquor license where no alcoholic beverages will be consumed on the premises must have at least one certified person on the premises at all times to be responsible for all sales of alcoholic beverages.
      (2)   Those with any additional liquor sales license must certify each and every person who shall be serving or dispensing alcoholic beverages to the public.
   (B)   Each seller or retailer shall, at the time of applying for its liquor license, designate in writing a Kentucky resident who shall be responsible for compliance with this section.
   (C)   The local ABC Officer, in accordance with his or her duties of enforcement under KRS Statutes and KAR regulation, may take into consideration that
the seller or retailer is in full compliance with all requirements hereunder.
