(A) It shall be unlawful to engage in the activity of garbage collection, including dumpster type collection, within the city between the hours of 11:00 p.m. and 6:00 a.m. on any day.
(B) As used herein,
GARBAGE COLLECTION shall mean any of the following activities:
(1) Emptying of garbage cans into a garbage collection truck;
(2) Loading, unloading, maneuvering, positioning, or emptying a dumpster or similar type container;
(3) Using a garbage collection truck to compact garbage by any process.
(C) The registered owner of a garbage collection truck being used in violation of this section shall be prima facia evidence of ownership of the vehicle and of violation of this section by such owner.
(D) This section shall not apply to garbage collection where the site is more than 1500 feet, measured in a straight line, from the nearest residential use property line.
