1323.05 EXISTING DRIVEWAYS; CONFORMITY REQUIRED.
   Existing driveways, turning areas and parking areas which are nonconforming on the effective date of this section by reason of noncompliance with the provisions of Section 1172.02 of the Planning and Zoning Code and Section 1323.03 of this Building and Housing Code, or a subsequent amendment thereof, shall be deemed nonconformities. Any nonconformity arising because of any increase in driveway or parking area resulting from an addition to a driveway, turning area or parking area, if constructed pursuant to a City permit and in place on the effective date of this section, and which remains a nonconformity upon any subsequent amendment thereto, may be continued so long as repairs thereto do not exceed forty percent or more of the area of the driveway or parking area and there is no change in the use of the nonconformity, provided, however, that in all instances such nonconformity shall be removed, altered or brought into conformity with the provisions of this section no later than September 30, 1990. Any nonconformity due to an original driveway, turning area or parking area (without alteration or addition) being rendered nonconforming by the provisions of this section may be continued so long as repairs thereto do not exceed forty percent or more of the area of the driveway or parking area and there is no change in the use of the nonconformity.
