1110.05 POWERS AND DUTIES.
   The City Planning Commission shall have the following authority:
   (a)    Pursuant to Article V, Section 7, of the City Charter, the Planning Commission shall review and make recommendations to the Council to approve, disapprove, or approve with conditions, the following matters:
      (1)   The planning, design, location, removal, relocation and major alteration of buildings or structures located in the City which require site plan review;
      (2)   The location, relocation, widening, extension and vacation of streets, highways, playgrounds and other public spaces;
      (3)    Plats for the subdivision of land; and
      (4)    The zoning or rezoning of the City for any lawful purpose or purposes.
   (b)   In addition to the powers conferred by the City Charter, the Planning Commission shall have the following powers and duties:
      (1)   To review and approve, disapprove, or approve with conditions, an application for a conditional use for a particular zoning lot;
      (2)   To determine that a proposed use that is not explicitly listed or provided for in the Zoning Code is substantially similar to a principal or conditionally permitted use that is listed or provided for in this Zoning Code;
      (3)   To review proposed development plans in accordance with Chapters 1162, 1164 and 1166 of the Zoning Code;
      (4)   To review ordinances or proposed ordinances, regulations or plans on its own volition or at the request of Council, including ordinances or regulations to amend the Zoning Code and Zoning Map, and plans or studies with respect to the use and/or development of land within the City;
      (5)   To adopt rules and bylaws for the holding of regular and special meetings for the transaction and disposition of its business and the exercise of its powers;
      (6)   To review the proposed change of a nonconforming use to another nonconforming use of the same degree of nonconformity, as determined by the most restricted district in which the existing nonconforming use is permitted. (Ord. 96-61. Passed 4-21-97.)
