(a) Findings and Purpose. Council finds that the City has had a low incidence of accidental injuries on public sidewalks by reason of defects therein due to the continuous maintenance which has been provided by the City in its annual sidewalk repairs programs. Council also finds that the City prescribes the specifications for the construction of sidewalks in Sections 905.02
and 1136.14
of these Codified Ordinances and acquiesces in bicycle operation on public sidewalks in Section 474.07
(d), (e) and (f) of these Codified Ordinances. Council also finds that its routine maintenance program is conducive to the health, safety and welfare of the public by minimizing the possibility of injury and enhancing the public prosperity by limiting the expenses which are the natural result of claims arising out of injury whether in payment for such injuries or the defense thereof. Council declares that sidewalks determined to be public nuisances shall be repaired to abate the nuisance pursuant to Section 1385.24
