1133.02 DEFINITIONS.
"Act" The Fair Housing Amendments Act of 1988 and/or R.C. § 4112.02(H).
"Applicant." The individual making the request for a reasonable accommodation pursuant to this policy and the Village of Lowellville Ordinances.
"Department." The Village of Lowellville Zoning Department.
"Disability." Any person who has a physical or mental impairment that substantially limits one or more major life activities; anyone who is regarded as having such impairment or; anyone who has a record of such impairment. People who are currently using illegal substances are not covered under the Act, unless they have a separate disability.
"Housing providers" are:
   (A)    Those involved with housing related transactions. This can include landlords, sellers, brokers, real estate agents, lenders, insurance agents, property managers, maintenance staff, and many others in the housing industry. The fair housing law applies to all housing providers, as well as neighbors and guests of residents.
   (B)    Any Person that owns, master leases, manages, or develops Housing in the Village. In addition, any agent, such as a property management company, that makes tenancy decisions on behalf of the above described Persons, and any government agency that makes eligibility decisions for tenant based rental assistance programs, including, but not limited to, the Section 8 Housing Choice Voucher Program, shall also be considered a "Housing Provider."
"Person" includes one or more individuals, partnerships, organizations, trade or professional associations, corporations, legal representatives, trustees, trustees in bankruptcy, or receivers.
"Variance." As defined in the Village Ordinances. In addition, variance includes situations where the Act prohibits strict enforcement of the terms of the Village's Zoning Ordinances.
