(a) After the refusal of the Design Review Board to approve an application, the aggrieved person may make a written appeal to the Board of Zoning Appeals, specifying the grounds for the appeal. Such appeal shall be made within twenty days after the decision of the Design Review Board. Upon payment of a fee set by Council, the Board of Zoning Appeals will review and rule on the appeal of the applicant.
(b) The appeal shall follow procedure under Chapter 1125 of the Codified Ordinances. In the hearing, the applicant has the burden of showing why he is unable to comply with the design review criteria, and to show whatever hardship he would incur by not fulfilling the intent of the Zoning Ordinance. The full record of the hearing shall become a part of the record of the Design Review Board. (Ord. 2818. Passed 11-29-95.)
