(A) Any person who violates any provision of this chapter shall be subject to a fine of $25 for the first offense, $50 for a second offense occurring within 90 days, $100 for a third offense occurring within one year, and $250 for each subsequent offense occurring within one year. (B) Any person who violates any provision of this chapter or Chapter 75 shall be subject to the penalty provided in § 70.99.
(C) Any person who violates any provision of this chapter or Chapters 71 or 75 shall be given a notice by the town, either orally or in writing, to move the vehicle within 24 hours from the time of notice. Failure to move the vehicle within the period of time shall constitute authority to the town to have the vehicle towed away at the owner's expense. Notwithstanding the foregoing, the town shall have the authority to tow a vehicle parked in violation of § 72.01 at the owner’s expense without the necessity of giving prior notice to move the vehicle. (D) Members of the Police Department are authorized to impound a vehicle owned or leased by a person who has two or more unpaid fines for parking violations. In addition to the fine, the owner or lessee of the vehicle shall be responsible for all costs incurred in towing and storing the vehicle. The unpaid fines and the costs for towing and storing the vehicle must be paid in full before the vehicle is released. (Ord. 2009-05, passed 5-11-09)
