§ 52.065 TYPE OF PROTECTION REQUIRED.
   The type of protection required by this subchapter shall depend on the degree of hazard which exists, as follows:
   (A)   An approved air gap separation shall be installed where the public potable water system or the consumer water system may be contaminated with substances that could cause a severe health hazard.
   (B)   An approved air gap separation or an approved reduced pressure principle (RPZ) backflow prevention device shall be installed where the public potable water system or consumer water system may be contaminated with a substance that could cause a health hazard.
   (C)   An approved air gap separation, reduced pressure principle backflow prevention (RPZ), double check valve assembly, pressure vacuum breaker, atmospheric vacuum breaker, or frost free vacuum breaker shall be installed where the public potable water system or consumer water system may be polluted with substances that could cause a pollutional hazard not dangerous to health.
   (D)   In the case of any premises where, in the opinion of the Water Commissioner or Utilities Superintendent, an undue health threat is posed because of the presence of extremely toxic substances, the Water Commissioner or Utilities Superintendent may require an air gap at the service connection to protect the public water system. This requirement will be at the discretion of the Water Commissioner or Utilities Superintendent and is dependent on the degree of hazard.
