§ 39.045 SCHEDULE OF FEES FOR EMERGENCY MEDICAL SERVICES.
   (A)   The Secretary of the Cabinet for Public Protection (the "Secretary") shall promulgate a schedule of fees for Louisville Metro Emergency Medical Services ("EMS"), which shall reflect as nearly as possible the actual cost of services rendered and materials used by EMS. Such fees shall be reasonably related to costs attributable to such incidents and to charges for similar services in the region. The Secretary shall take care to insure that the schedule of fees is maintained in accordance with current costs of rendering the services, and shall, from time to time, promulgate such amendments to the schedule as may be necessary to adhere to the policy of the Metro Government as expressed in this subchapter.

   (B)   The fee schedule adopted pursuant to this section shall be for transportation, medically-appropriate services and procedures, and for supplies used.
   (C)   Fees shall be reviewed on at least an annual basis by the Secretary, and the fee schedule amended accordingly.
   (D)   Following the promulgation of a schedule of fees for emergency medical services and any amendments that may be made thereto from time to time, Metro Government shall act to insure the collection fo the scheduled fees.
