The Agreement may be completely terminated by Metro Government. In the event the Metro Government terminates the Agreement, all property transferred from the Metro Government pursuant to the terms of the Agreement shall be returned to the Metro Government upon such termination of the Agreement. MSD shall be entitled to retain all property acquired by MSD that was not initially transferred to MSD by the City of Louisville, Jefferson County, or Metro Government. The Metro Government agrees that, in the event of termination, the Metro Government shall make adequate provision for payment of annual debt service on all outstanding debt issued by MSD for drainage purposes by MSD’s continued imposition of service charges to retire the debt by MSD, said service charges to be approved by the Metro Government.
