§ 37.21 PREFERENCE FOR QUALIFIED BIDDERS WITH APPRENTICESHIP PROGRAMS.
   (A)   The Department shall give a preference to all qualified bid responses resulting from a request for bid or request for proposal issued by the Department where construction or construction related services for any single project are estimated to be in excess of $250,000 and where it is determined by the Department that the qualified bidder has a registered apprenticeship program in accordance with the provisions of this subchapter.
   (B)   If the bid received complies with the requirements of this subchapter, then the bid price quoted by each qualified bidder shall be reduced by 3% of the proportional amount of the bid price attributable to the estimated labor cost of the project for purposes of determining the lowest bid price, or alternatively, 3 points shall be added to the evaluated bid total.
   (C)   Each invitation for bid or request for proposal that meets the requirements of this subchapter shall state explicitly that preferences shall be afforded to qualified bidders in accordance with the provisions of this subchapter.
   (D)   Each qualified bidder must provide to the Department a certified copy of the registered apprenticeship program as sworn to by a notary public and the number of apprentices enrolled in the program at the time of bid submission, and any apprenticeship agreements, as may be requested by the Department.
   (E)   For purposes of determining the lowest bid price, or alternatively the evaluated bid total, the preference in this subchapter can be combined or accumulated with the local business preference. This subsection (E) supersedes § 37.02(G) of Ordinance No. 233-2003 only to the extent that such ordinance would prohibit the combination or accumulation of the preference in this subchapter with the local business preference. However, this subchapter shall not be combined or accumulated with the following preferences: minimum wage, health insurance, and/or any other preference, which may be enacted after the effective date of this subchapter, unless otherwise provided.
   (F)   A qualified bidder who is awarded the contract to do the project shall maintain payroll records pertaining to such project for inspection by the Department or any other agency or department of Metro Government. These records shall be maintained for at least six months after the completion of the project.
