521.12 OPEN BURNING.
   (a)    No person shall cause or allow open burning except as provided herein:
      (1)    Cooking for human consumption.
      (2)    Heating tar, welding, acetylene torches, highway safety flares, heating for warmth of outdoor workers, smudge pots and similar occupational needs.
      (3)    Recognized silvicultural, range or wildlife management practices.
      (4)    Prevention or control of disease or pests.
      (5)    Ceremonial purposes. Ceremonial fires shall be less than five feet by five feet in dimension and shall burn no longer than three hours.
      (6)    Instruction in methods of firefighting or for research in control of fires.
      (7)    Recognized agricultural or horticultural management purposes to maintain or increase the quantity or quality of agricultural or horticultural production.
   Fires allowed by the above shall not be used for waste disposal purposes and shall be of a minimum size sufficient for their intended purposes; the fuel shall be chosen to minimize the generation and emission of air contaminants.

   (b)    Whoever violates this section is guilty of a minor misdemeanor; a separate offense shall be deemed committed each day during or on which a violation occurs or continues.
