521.10 GARBAGE AND RUBBISH COLLECTION, STORAGE, BURNING, TRANSPORTING.
   (a)    Definitions. As used in this section:
      (1)    "Garbage" means fruits, vegetables, meats, fish, fowl or any refuse accumulation of the same or matter of anything whatsoever which will decompose and become foul, offensive or dangerous to health.
      (2)    "Rubbish" means all waste material and refuse other than garbage which accompanies the use or occupancy of buildings or premises, including such unwanted items as paper, rags, bottles, boxes, tin cans, glass, ashes and combustible refuse which may not be in a decomposed stage.
      (3)    "Transport" means transportation in any manner along the streets, highways or public or private property within the corporate limits of the City.

   (b)    Collection. 
      (1)    No person, firm or corporation shall collect, remove, convey or transport any garbage, by any means whatsoever, in, on, over or upon any street, alley, highway, vacant lot orpublic place within the City unless such person, firm or corporation has first obtained from Council authority to do so as evidenced by a written contract.
      (2)    No person, firm or corporation being the owner or tenant of any land or building in the City shall authorize any person, firm or corporation to collect, remove, convey or transport any garbage from any land or building within the City by any means whatsoever, in, on, over or upon any street, alley, highway, vacant lot or public place within the City unless such person so collecting, removing and conveying or transporting such garbage has first obtained from Council authority to do so as evidenced by written contract.

   (c)    Burying. No person shall bury or permit buried within the City any garbage, vegetables, dead animals or other organic substance, unless it is covered with not less than two feet of tamped ground.

   (d)    Burning. No person shall burn or permit burned within the City any garbage or rubber substance except in a heating furnace or in a device designed and commercially sold for the specific purpose of incineration.

   (e)    Containers. Every owner or tenant occupying any building, premises, place of business or other place which creates garbage shall forthwith provide and at all times thereafter keep and maintain thereon a suitable metal garbage can or cans for receiving and holding garbage pending the removal thereof. All garbage cans shall be constructed of metal, and shall be watertight with a close fitting lid, which lid shall at all times be in position so as to prevent ingress and egress of flies, and the container shall not exceed twenty gallons capacity. In no event shall the container be used by more than one family, household, restaurant or hotel, and all garbage created by or belonging to the owner or tenant shall be deposited in the container. This section shall not apply to garbage of any owner or tenant who disposes of garbage by means of garbage disposal or incineration in a device designed for and commercially sold for such purpose.
   (f)    Collecting; Transporting; Schedule. 
      (1)    No garbage shall be collected or hauled through the streets of the City except as provided in the contract with the garbage contractor.
      (2)    No rubbish shall be collected or hauled through the streets of the City except in vehicles so constructed as to prevent dripping or spillage of the contents onto the streets. Each of the vehicles shall be covered with a metal or canvas cover or tarpaulin after being loaded and while enroute.
      (3)    No collections of garbage or rubbish shall be made before 5:30 a.m. or after 7:30 p.m. local time in the City on any weekday. No collections of garbage or rubbish shall be made on Sundays or legal holidays.

   (g)   License Required. No person, firm or corporation shall collect, remove, haul, convey or transport by any means whatsoever any rubbish in, on, over or upon any street, alley, highway, vacant lot or public place within the City, for a charge, unless such person, firm or corporation holds a valid rubbish hauler license issued by the City Manager. Licenses shall be issued by the City Manager upon the payment of a fee for a period of one full calendar year. Such fee shall be prorated on a monthly basis if first obtained after commencement of the calendar year. Licenses may be revoked at any time by the City Manager if it appears that the licensee has pleaded guilty, or has been convicted for the violation of any ordinance of the City pertaining to garbage and rubbish collection.

   (h)    Misdemeanor Classification. Whoever violates this section is guilty of a minor misdemeanor; a separate offense shall be deemed committed each day during or on which a violation occurs or continues.
