339.12 EMERGENCY SIGNAL EQUIPMENT.
   (a)   No person shall operate any motor truck, bus or commercial tractor upon any street or alley at any time from a half-hour after sunset to a half-hour before sunrise unless there is carried in such vehicle, except any motor vehicle transporting flammable liquid in bulk or flammable gases, the following equipment which shall be of the types approved by the State Director of Transportation:
      (1)    At least three flares or three red electric lanterns each of which is capable of being seen and distinguished at a distance of 500 feet during normal atmosphere conditions at night time;
      (2)    At least three red-burning fuses unless red electric lanterns are carried;
      (3)    At least two, red cloth flags, not less than twelve inches square, with standards to support them. Under like conditions no person shall operate any motor truck, bus or commercial tractor used in transporting flammable liquid in bulk or compressed flammable gases unless there is carried in such vehicle three red electric lanterns meeting the requirements stated above and there shall not be carried in any such vehicle any flares, fuses or signal produced by a flame.

   (b)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
