1139.04 REMEDIES AND PENALTIES FOR VIOLATIONS.
   (a)    Remedies for Violations.
      (1)    In case any building is or is proposed to be located, erected, constructed, reconstructed, enlarged, changed, maintained or used or any land is or is proposed to be used in violation of any provisions of this Unified Development Ordinance or supplements or amendments thereto, Council, the Law Director, the Zoning Inspector or any adjacent or neighboring property owner who would be especially damaged by such violation, in addition to other remedies provided by law, may institute injunction, mandamus, abatement or any other appropriate action or proceeding to prevent, enjoin, abate or remove such unlawful location, erection, construction, reconstruction, enlargement, change, maintenance or use.
      (2)    Right to abatement.
         A.   When Bids Required. If it is necessary for the City to remove or repair a structure pursuant to the notice provisions hereof, bids shall be taken when the estimated costs of demolition or repair exceed five hundred dollars ($500.00).
         B.    Certification of Work Performed. When abatement by the City is completed, the City Clerk shall certify the legal description of the property upon which the work was done, together with the name of the owner thereof, as shown by the tax rolls of the related municipal area, together with a statement of work performed, the date of performance and the cost thereof.
         C.    Demand for Payment. The cost of correcting the unlawful structure together with an administrative charge of two hundred dollars shall be reported to the Director of Finance, who shall mail a statement of the amount thereof to the owner of the land, if his address is known.
         D.   Assessment of Costs and Penalty. If, after 30 days, such amount remains unpaid or in the instance where the address of the owner is unknown, the Director of Finance shall certify the total amount of the expenses, the name of the owner of the property and a sufficient description of the premises to the County Auditor to be collected as other taxes and assessments and returned to the city, pursuant to Ohio R.C. 731.54.
   (b)   Penalties for Violations. Whoever violates any provision of this Zoning Ordinance or supplements or amendments thereto is guilty of a minor misdemeanor. A separate offense shall be deemed committed each day during or on which a violation occurs or continues.
