1139.02 INSPECTIONS AND COMPLAINTS REGARDING VIOLATIONS.
   (a)    Complaints. Any person may file a complaint in regard to an alleged violation. All complaints shall be in writing and shall be filed with the Zoning Inspector, who shall properly record and investigate the alleged violation.
   (b)    Right of Entry. The Zoning Inspector is authorized to enter a premise, subject to constitutional restrictions on unreasonable searches and seizures, at reasonable times for the purpose of determining whether there is compliance with the provisions of this UDO. If entry is refused or not obtained, the Zoning Inspector is authorized to pursue recourse as provided by law.
   (c)    Procedures upon Discovery of Violations.
      (1)    Notice to owner.
         A.   If the Zoning Inspector finds that any building or other structure regulated herein is unsafe or insecure, or is a menace to the public or has been constructed or erected or is being maintained in violation of the provisions of this chapter, notice shall be given in writing by the Zoning Inspector to the owner.
         B.    Notice shall be given by certified mail to the latest permit holder or to the property owner, or to such owner's spouse or agent, or to the person otherwise in charge of such development or premises. In the event no such named person may be found, or when deemed proper by the Zoning Inspector, the development or premises shall be posted with the notice.
         C.    The notice given by the Zoning Inspector shall state not only the remedial action required to be taken but shall also state that if such action is not taken within a reasonable time limit set forth by the Zoning Inspector, remedies and penalties for violations may be sought, or the cost of correcting the unlawful structure together with an administrative charge of two hundred dollars.
      (2)    Persons liable. For all purposes hereinafter, the owner of the premises shall be presumed to be the owner of all structures thereon, unless the contrary shall appear from facts brought to the attention of the City. In the event the owner of the premises or person entitled to the possession of the property or structure fails, neglects, or refuses to comply with the notice, the owner of the premises and the person entitled to possession thereof, if other than the owner of the premises, or all or any of them may be prosecuted for violation of this chapter.
