1138.04 COUNCIL ACTION ON AMENDMENTS.
   (a)    At the conclusion of the Legislative Hearing or within twenty (20) days after the legislative hearing, City Council shall adopt or reject the Ordinance for UDO amendment, or adopt a modification to the Ordinance for UDO amendment.
      (1)    An affirmative vote of a simple majority of the members elected to City Council is required to adopt or reject an Ordinance which is in accordance with the recommendations, plan, or report submitted by the Planning Commission.
      (2)    Any vote that is less than a majority for approval shall be deemed as denial of the recommendation of the Planning Commission.
      (3)    If the Ordinance recommended by the Planning Commission is adopted by City Council with amendments that violate, differ from or depart from the recommendation submitted by the Planning Commission, it shall only take effect if it is approved by not less than three-fourths (3/4) of the membership of Council.
         A.    No additional review by the Planning Commission shall be required.
         B.    Where the amendment to the Ordinance constitutes a change of substance, Council shall follow the requirements of Article II, Section 18 of the City Charter (Further Consideration and Final Passage) to finally pass such amended Ordinance.
   (b)    Council, by an affirmative vote of three-fourths of the members elected thereto, may adopt an emergency ordinance pursuant to Section 19 of the City Charter (Emergency Ordinances) which shall take effect upon passage.
