Whoever divides any parcel of land, whether by instrument of conveyance or otherwise, for which division no plat is required by reason of the Ohio Revised Code, or consolidates lots into a single parcel, shall submit such division to the Zoning Inspector for review by the Planning Director.
(a) Submission Requirements. Minor Subdivision and Lot Consolidation Technical Review shall require submission of the following data and drawings:
(1) Application. A completed, signed, application for a Development Permit and payment of the appropriate fee.
(2) Certificate of ownership. The following endorsement shall be submitted with the application and shall be signed and dated by the property owner(s) of record: “I (we) hereby certify that as the owner of the property described hereon, which property is within the jurisdiction of the City of Louisville, I (we) freely adopt this plan of subdivision.”
(3) Boundary survey. Two (2) copies of a Boundary Survey of the parcel or parcels sought to be subdivided or consolidated meeting all requirements of this UDO and prepared by a registered surveyor licensed in the State of Ohio.
(4) Utility plan. A utility and utility easement plan which addresses any unusual conditions or capacity requirements that would affect utilities or require utility easements located outside the public right-of-way.
(b) Action by the Planning Director. Within seven (7) working days after submission of a minor subdivision or a lot consolidation application or within a mutually agreed upon extension, the Planning Director shall either approve or disapprove the application. In considering such an application, the Planning Director shall consider required minimum lot sizes, lot width requirements, and similar applicable requirements found in this UDO. If the Planning Director does not approve the Minor Subdivision or Lot Consolidation, the applicant shall be notified in writing of the reason for disapproval. If the Planning Director approves the Minor Subdivision or Lot Consolidation, the conveyance shall be signed "Approved by the Planning Director of the City of Louisville, Ohio; No Plat Required", along with the date of approval.
(c) Automatic Termination of Approval. The approval shall expire within one (1) year, unless the conveyances are recorded in the office of the County Recorder during such period.
