A developer requesting approval of modifications to approved plans (including Plot Plans, Site Plans, and/or Development Plans), Development Permits, or Subdivision Approvals shall submit a written request for such modifications to City Development Staff. The request shall clearly identify each of the proposed changes. Approval of all changes must be given in writing and made part of the official record.
(a) Insignificant deviations are permissible and may be authorized by the Planning Director. A deviation is insignificant if it has no discernible impact on neighboring properties, the general public, or those intended to occupy or use the proposed development.
(b) Minor design modifications or changes are permissible with the approval of the Planning Director and any boards or commissions involved in the original approval of the application that resulted in the issuance of the Development Permit. Such permission may be obtained without a formal application, public hearing, or payment of any additional fee. For purposes of this section, minor design modifications or changes are those that have no substantial impact on neighboring properties, the general public, or those intended to occupy or use the proposed development.
(c) All other requests for modifications to approved plans, Development Permit, or Subdivision Approvals will be processed as new applications. If such requests are required to be acted upon by any boards or commissions, new conditions or requirements may be imposed where such authority exists, but the applicant shall retain the right to reject such additional conditions by withdrawing the request for a modification and proceeding in accordance with the previously issued Development Permit or Subdivision approval.
(d) The Planning Director shall determine whether the proposed modifications to plans, Development Permits, or Subdivision Approvals fall into the categories of insignificant deviations or minor design modifications or changes.
