(a) Except as otherwise specifically provided, primary responsibility for administering and enforcing this Unified Development Ordinance may be assigned by the City Manager to one or more individuals. The person or persons to whom these functions are assigned shall be referred to in this UDO as “development staff.” Council shall establish and the City Manager shall fill development staff positions, together with such assistants as Council deems necessary. The term of employment, rate of compensation and other such conditions shall be set by Council.
(b) Planning Director. The Planning Director is the administrative head of the Planning and Development Department. The Planning Director shall have the right to refer any application to the Planning Commission for guidance or recommendation.
(c) Zoning Inspector. It shall be the duty of the Zoning Inspector to enforce this Unified Development Ordinance. It shall also be the duty of all officers and employees of the City and especially of all members of the Division of Police to assist the Zoning Inspector by reporting new construction, reconstruction or land uses, and apparent violations of this UDO.
(1) The Zoning Inspector shall have the authority to:
A. Inspect all improvements to insure conformity with the approved plans and specifications as contained in the Development Permit or Plat Approvals.
B. Inform the contractor in writing of any failure of the work or materials to conform to the specifications and contract.
C. Suspend the portion of the work involved until any question at issue can be referred to and decided by the Planning Director.
D. The Zoning Inspector shall not have authority to revoke, alter, or waive any requirements of the specifications or plans approved by any City administrative review board.
(2) The Zoning Inspector shall issue Certificates of Appropriateness, Development Permits, or Certificates of Zoning Compliance according to this UDO. Such certificates or permits shall be in such form as may be prescribed by the Planning Director, consistent with the requirements of this UDO.
(3) Appeal from an action or decision of the Zoning Inspector may be made to the Board of Zoning Appeals as provided in Section 1136.01.
(d) City Engineer. The City Engineer shall be responsible for the inspection of all street improvements including commercial site development, parking lots, stormwater utility drainage, and sanitary sewers.
(1) Assistant Inspectors under the authority of the City Engineer shall be authorized to make periodic inspections of all work done and all materials furnished during the installation of street and storm and sanitary sewer improvements to insure conformity with the approved plans and specifications as contained in the subdivider's construction agreement. Such inspection may extend to all or any part of the work and to the preparation, fabrication or manufacture of the materials to be used. The inspector shall not be authorized to revoke, alter or waive any requirements of the specifications or plans. Inspectors shall be authorized to call the attention of the contractor to any failure of the work or materials to conform to the specifications and contract. Inspectors shall have the authority to reject materials which do not meet specification requirements or suspend the portion of the work involved until any question at issue can be referred to and decided by the City Engineer.
(2) The City Engineer or his deputy shall make a final inspection of streets, storm sewers and sanitary sewers. Inspections shall be promptly made after request by the subdivider.
