1333.01 DEFINITIONS.
   The following definitions shall apply in the interpretation and enforcement of this Property Maintenance Code.
   (a)   "Approved" means approved by the Property Maintenance Official or his designee.
   (b)   "Basement" means that portion of a building which is partially or completely underground.
   (c)   "Bathroom" means a room containing plumbing fixtures including a bathtub and shower.
   (d)   "Cellar" means that portion of a building which is partially or completely underground.
   (e)   "Deteriorate" means a condition or appearance of the exterior of a building or part thereof, characterized by holes, breaks, rot, crumbling or cracking, peeling, rusting or other evidence of physical decay, neglect or lack of maintenance.
   (f)   "Dilapidated" means no longer adequate for the purpose or use for which it was originally intended and in need of repair.
   (g)   "Dormitory" means a space in a building where group sleeping accommodations are provided in one room, or in a series of closely associated rooms, for persons not members of the same family group.
   (h)   "Dwelling" means any enclosed space wholly or partly used or intended to be used for living, sleeping, cooking and eating provided that temporary housing as hereinafter defined shall not be classified as a dwelling. Industrialized units which conform to the Ohio Basic Building Code and used or intended for use for living, sleeping, cooking and eating purposes shall be classified as dwellings.
   (i)   "Egress" means an arrangement of exit facilities to assure a safe means of exit from buildings.
   (j)   "Exterior of premises" means those portions of a building which are exposed to public view and the open space of any premises outside of any building.
   (k)   "Family" mean an individual or married couple and the children thereof with not more than two other persons related directly to the individual or married couple by blood or marriage, or a group of not more than five unrelated persons, living together as a single housekeeping unit in a dwelling unit.
   (l)   "Foundation" means that portion of a structure, below or partially below grade, which provides support of exterior walls and other structural parts of a building.
   (m)   "Garbage" means the animal or vegetable waste resulting from the handling, preparation, cooking and consumption of food.
   (n)   "Habitable floor area" means space in a structure for living, sleeping, eating or cooking. Bathrooms, toilet compartments, closets, halls, storage or utility spaces and similar areas are not considered habitable areas.
   (o)   "Infestation" means the presence within or contiguous to a structure or premises of insects, rats, rodents, vermin or other pests.
   (p)   "Kitchen" means any room having a floor area of sixty square feet or more used for the storage of foods, preparation of foods and/or containing the following equipment: sink and/or other device for dish washing, stove or other device for cooking or storage of food, cabinets and/or shelves for storage of equipment and utensils, and counter or table for food preparation.
   (q)   "Occupant" means any person living or sleeping in a building or having possession of a space within a building.
   (r)   "Operators" means any person who has charge, care or control of a structure or premises which is let or offered for occupancy.
   (s)   "Owner" means any person, agent, firm or corporation having a legal or equitable interest in the property; or recorded in the official records of the State, County or Municipality as holding title to the property; or otherwise having control of the property, including the guardian of the estate of any such person, and the executor or administrator of the estate of such person if ordered to take possession of real property by a court.
   (t)   "Person" mean an individual, corporation, partnership or any other group acting as a unit.
   (u)   "Premises" means a lot, plot or parcel of land including the buildings or structures thereon.
   (v)   "Property Maintenance Officer" means the official appointed by the City Manager who is charged with the administration and enforcement of this Code or any duly authorized representative.
   (w)   "Rooming house" means a dwelling or that part of any dwelling containing one or more rooming units in which space is let by the owner to three or more persons who are not related to the owner.
   (x)   "Rubbish" means any combustible and noncombustible waste material except garbage, including, but not limited to, the residue from the burning of wood, coal, paper, rags, rubber, leather, tire and yard trimmings, metals, glass and other like materials.
   (y)   "Structure" means anything built or constructed to serve any purpose, occupied or not occupied.
   (z)   "Workmanlike" means executed in a skilled manner, for example, generally plumb, level, square, in line, undamaged and without marring adjacent work.
