953.01 PROCEDURE FOR EXTENSION OF UNDERGROUND WIRING FOR STREET LIGHTING.
   (a)    Where an area served by back yard or underground electrical wiring desires street lighting with underground wiring, a written petition signed by a majority of the property owners in the area together with a map of the area shall be filed with Council. The petition shall name an agent for the petitioners, shall recite that the petitioners will bear the total cost of the extension of the underground electrical wiring to the pole locations, which pole locations will be determined by the City in consultation with the electrical supplier, now the Ohio Power Co.
   (b)    If Council determines that the petition of the property owners is satisfactory, they shall request the City Manager to obtain cost estimates from the electric power company, now the Ohio Power Co.
   (c)    The City Manager upon receipt of the cost estimates shall notify Council and petitioners' agent of same.
   (d)    Upon notification of petitioners' agent that the petitioners have the total cost available for deposit with the City, Council, by resolution unless otherwise provided by law, may direct the City Manager to proceed with the underground wiring upon payment to the City by the petitioners of the cost of installation. The City shall hold the deposit of money for such purpose and any sums not used shall be returned to petitioners' agent; if the original deposit is insufficient to cover the cost, the petitioners shall deposit additional sums as required by Council.
