721.10 DRILLING REGULATIONS; LOCATION AND TIME LIMIT.
   (a)   No permit shall be issued to drill an oil or gas well unless the proposed well, sludge pit, storage tanks and other installations or equipment used at oil and gas wells are located:
      (1)   In a designated I-2 Industrial Manufacturing and Storage District under the Zoning Ordinance presently in force and hereafter amended.
      (2)   Upon a tract or drilling unit containing not less than forty acres which forty-acre tract shall only include acreage designated as an I-2 Industrial Manufacturing and Storage District under the City Zoning Ordinance.
      (3)   Not less than 1,000 feet from any well drilling to producing from or capable of producing from same pool.
      (4)   Not less than 600 feet from a boundary of any designated residential zoning district.
      (5)   Not less than 500 feet from a boundary line of the subject tract or drilling.
      (6)   Not less than 250 feet from any building designed for human occupancy or building where the public assembles or congregates.
      (7)   Not less than 150 feet from any road, highway, street or alley and not nearer than fifty feet to a railroad tract.
   (b)   All permittees shall provide a twenty-five thousand dollar ($25,000) road bond which shall be placed with the City Finance Director to insure that all roads are properly improved from any damage incurred from the drilling of the oil or gas well. Bond shall remain in effect until the City Manager has determined that all damage to roads has been corrected to his satisfaction.
   (c)   When a permit required by Section 721.01 has been issued, the same shall terminate and become inoperative, without any action on the part of the City unless, within ninety days from the date of issue, actual drilling of the well has commenced, and after the drilling of a well has commenced, the cessation for a like period of the drilling operations, shall cause the termination and cancellation of the permit and the well shall be deemed abandoned for all purposes of this section, and thereafter, no person shall drill or operate any such well without the issuance of another permit.
   (d)   A permit issued pursuant to the ordinances and regulations provided for by the City shall not be transferable. It may, however, be reissued as a new permit to a successive owner.
