642.31 SPRING CLEAN-UP PROGRAM.
   (a)   Council may authorize a contract on an annual or bi-annual basis, as Council deems appropriate, with any contractor operating at the time under a franchise agreement with the Village for trash collection, for pick-up, removal and disposal of trash, garbage, rubbish and large items, as those terms are defined in the Village Trash Collection Franchise Agreement at Village expense. The agreement shall provide for a one time pick-up throughout the Village and shall be known as the Village of Loudonville Spring Clean-Up Program. Such Spring Clean-Up Program shall permit residents of the Village to place garbage, rubbish, large items and trash at or near the street for pick-up on such date and under such regulations as determined by Council for pick-up and disposal at Village expense.
   (b)   Any person placing trash, rubbish, garbage or large items, as those terms are defined in the Village Trash Collection Franchise Agreement, at or near the street in conjunction with the Village of Loudonville Spring Clean-Up Program, and in compliance with the rules and regulations established for such by the Council and Mayor of the Village of Loudonville, shall be deemed to have transferred ownership of any such property to the Village immediately upon the placing of such property at or near the street, and thereafter, no person shall remove such property therefrom except for the contractor operating under the direction of Village officials, and acting within the scope of their duties pertaining to removal of such rubbish, garbage, trash or large items in conjunction with the Village Spring Clean-Up Program.
   (c)   No person shall place any trash, rubbish, garbage, large items or other at or near the street for collection by the Village, its employees, the franchisee, the employees of the franchisee, or any other entity authorized by Village Council pursuant to the Village Spring Clean- Up Program, where such trash, rubbish, garbage, large items or other property has been transported to the Village of Loudonville from a location outside the corporation limits of the Village of Loudonville, within seven days prior to the placement or deposit of such trash, rubbish, garbage, large items or other property at or near the street for pick-up.
   (d)   Whoever violates any provision of this Section shall be guilty of a minor misdemeanor and shall be fined not more than one hundred dollars ($100.00). A separate offense shall be deemed committed each day during or on each which a violation occurs or continues. (Ord. 34-95. Passed 5-1-95.)
