636.18 CURFEW.
   (a)   Definitions As used in this section:
      (1)   “Minor” means any person up to eighteen years of age.
      (2)   “Other adult” means any person twenty-one years of age or over in loco parentis to the minor.
      (3)   “Legitimate business” means participation in or attendance of bona fide religious, public or civic groups which are supervised by an adult. This definition includes such groups as YMCA, YWCA, Boy Scouts of America, public schools and churches, but this list is not exclusive. This definition also includes the lawful employment of such minor.
      (4)   “Legal excuse” means any activity which makes it necessary for the minor to violate the curfew laws to protect some person’s physical integrity or well-being. This definition includes emergency errands for the protection of health, safety or well-being of another in imminent danger.
      (5)   “Places of amusement” means those places which are privately owned and available for occupancy or used by the general public for the purpose of economic benefit to the owner or the enjoyment or well-being of the general public.
   (b)   Prohibitions.
      (1)   No person, being a minor, shall be upon the streets, highways, any public place or place of amusement between the hours of 12:00 midnight and 5:00 a.m. unless accompanied by a parent.
      (2)   No person, being a minor under the age of sixteen, shall be upon the streets, highways, any public place or placement of amusement between the hours of 11:00 p.m. and 5:00 a.m. of the following day.
      (3)   The provisions of subsections (a) and (b) hereof shall not apply to a minor accompanied by his or her parent, guardian or other adult.
      (4)   The provisions of subsections (a) and (b) hereof shall not apply to a minor pursuing a legitimate business at the direction of a parent, guardian or other adult.
      (5)   The provisions of subsections (a) and (b) hereof shall not apply to a minor having an otherwise legal excuse for being upon the streets, highways, any public place or place of amusement during the prohibited hours.
   (c)   Enforcement. This section shall be in accordance with and governed by Ohio R.C. 307.71. Any person under the age of eighteen years who violates the provisions of this curfew shall be apprehended and charged as being an unruly child and taken before the Juvenile Court in Ashland County, as provided in Ohio R.C. Chapter 2151.
   Any minor so apprehended may be detained in the juvenile detention facility in the Ashland County Jail overnight pending transfer to the County Juvenile Detention Center operated by the Juvenile Court.
